General Terms & Conditions

1. General

The conditions of accommodation of the Hotel Farinet operated by Le Farinet SA (hereinafter "Hotel Farinet") and all related services are governed by this document "General Terms and Conditions", which may be amended at any time.

The term "Client" includes the contracting party(ies), even if he/ she is not physically occupying the room or suite, and even if the contract does not bear his/her signature.

2. Booking & Confirmation

The reservation must be made by an adult of at least 18 years of age, able and allowed to enter into a contractual agreement with Hotel Farinet. If an adult makes a booking, he/she is responsible for all minors travelling in the party.

When booking, the Client must provide his or her first name, surname, date and place of birth, nationality, mobile number, e-mail address, official place of residence, payment method, date of arrival and departure and the number of people who will occupy the room or suite; the age of any client under 18 years must be specified. The reservation becomes an official contractual agreement between the two parties concerned, upon confirmation by Hotel Farinet (issuance of reservation number) and when the appropriate guarantee is provided by the Client (secure payment by credit card number, approved invoicing, or a bank transfer received and validated by Hotel Farinet).

3. Payment

The room rates, fees and taxes will be charged to the credit card used to confirm the reservation for the full duration of their stay either in advance or on arrival; nonetheless the Client may change the method of payment during the stay or at check out. Rates are in Swiss Francs and are inclusive of VAT unless otherwise stipulated at the time of booking. City Tax of 4 CHF per adult per night and 2 CHF per junior per night will be charged in addition.

All reservations must be guaranteed with a valid credit card.

Additional charges are invoiced separately, except for items purchased from the hotel website. The Customer(s) and accompanying person(s), as well as any individual or company making the reservation accept and consent that Hotel Farinet will charge the credit card presented for payment.

For bookings with aflexible rate, pre-payment of the total amount of the stay will be taken 30 days before arrival.Excluding city tax which is due on arrival at the hotel. For non-refundable rate bookings, a non-refundable pre-payment of the full stay is required and will be charged at time of booking. Excluding city tax which is due on arrival at the hotel.

4. Arrival And Departure

Check-in is from 15:00 on the date of arrival, unless an arrangement has been made in advance.

Check-out is 11:00 on the date of departure, unless an arrangement has been made in advance for a late departure, subject to availability.

5. Duration Of Stay

The duration of stay is indicated on the booking confirmation as well as the arrival and departure dates.

6. Clients

The number of Clients allowed to stay in the room or suite is indicated on the booking confirmation.  Only the individuals listed on the reservation details are allowed to reside in the room or suite. A breach of this condition will be subject to an additional charge Hotel Farinet for the sum of CHF100 per night, per person.

7. Cancellation

For flexible rate bookings:

If cancelled or modified up to 30 days before date of arrival, no cancellation fee will be charged.

For a cancellation or modification after this period, the following charges apply:

  • Less than 30 days before arrival 100% of the total stay.
  • In the case of an early departure, the total stay reserved will be charged.
  • In case of no show the total amount of the stay will be charged incl VAT*

* In case of ‘no show’ by midnight of the day of your scheduled arrival (unless prior notice is given), your reservation will be cancelled and your reserved suite will no longer be available. No show will be charged in accordance with our no show policy.

For non-refundable rate bookings:

The guest will be charged the total price of the reservation if they cancel anytime. No cancellations or changes permitted for non-refundable rates. Full stay will be charged at the time of booking.

8. Rates – Rooms & Additional Services

Different rules apply for different prices based on the length of stay, which is indicated on the reservation confirmation.

Hotel Farinet reserves the right to amend prices at any time.

All outstanding amounts for any additional services added to the Clients bill during their stay will be debited from the credit card registered during the Check-in, unless other payment method is provided by the Client.

In the event that a Client has reserved a suite at Hotel Farinet on a non-refundable basis and paid on the date of reservation, no refund will be paid to the Client.

When a payment has been agreed or asked for and is not made even after expiry of a reasonable extension granted by Hotel Farinet, Hotel Farinet can withdraw from the contract.

Should a Client violate the agreed upon accommodation conditions (i.e. number of guest per room, pets etc.), Hotel Farinet reserves the right to change the price charged per night or move a Client to an alternative suite.

If a guest extends his/her stay and a new rate is offered, this will only apply to the nights taken after the initial period of the booking and not be pro-rated back over the full length of the stay.

9. Pets

Pets are not allowed at Hotel Farinet, without permission of Hotel Farinet and is subject to one of the rooms or suites allocated for use by guests with pets being available.

10. Non-smoking

Hotel Farinet (the rooms and suites, as well as the common areas) is a 100% non-smoking hotel. In the event of a breach of this rule, Hotel Farinet reserves the right to invoice the Client an additional charge (for cleaning, odour removal, etc.) of CHF 200.

11. Storage Of Luggage, Clients Personal Items And Safety Box

Luggage left with Hotel Farinet is done at the Clients’ risk.

Hotel Farinet declines all responsibility for personal items left with Hotel Farinet staff or in areas of hotel. Hotel Farinet has no obligation to store items of high value. Hotel Farinet has no responsibility for items left in the rooms and suites or in other areas of the hotel.

Objects forgotten by Clients after their departure from Hotel Farinet are sent only at the Client’s request, risk and cost. Hotel Farinet shall safe-keep such objects for a period of six months after communicating the find to the entitled party. Upon expiry of that time limit, Hotel Farinet acquires ownership of the object.

Hotel Farinet advises the Client to use the complimentary safety box located in the rooms and suites and declines any liabilities in case of theft.

12. Noise And Comfort Of Other Clients

The Client as well as accompanying person(s) agree to respect the privacy and comfort of other Clients. Hotel Farinet reserves the right to evict the Client and accompanying person(s), following complaints and/or as a result of non- respect of others, in such case Hotel Farinet will not reimburse any payment already made.

The Farinet comprises of not only the Hotel but also an After-Ski Bar, Lounge Bar, and Nightclub, open until 4am. The atmosphere is lively and consequently noise can travel up in to the hotel.

13. Behaviour And Conduct

Reasonable behaviour is expected at all times; unreasonable behaviour will not be tolerated. Management reserves the right to cancel your booking at any time if any person or group, who in the opinion of management behaves in an objectionable manner or contravenes the companies terms and conditions and there will be no refunds made for payments already received.

CCTV is in operation in common areas for security and service provision. For further information regarding the hotel CCTV applications should be made to the Hotel Manager.

14. Damages

During his/her stay or upon departure, the Client agrees to be liable for any damages and/or missing items and will be liable for the costs of replacement of the items.

Any damage caused by a Client and/or any person introduced by him/her to Hotel Farinet, will be repaired and all related costs charged to the relevant Client.

15. Liability

In case Hotel Farinet cannot provide the type of suite reserved by the Client, it will do its best efforts to offer an equivalent or superior alternative accommodation or, at its soles discretion, may offer full reimbursement.

Hotel Farinet is not responsible for any injury, illness, death, loss (for example loss of enjoyment), damage, expense, cost or other sum or claim of any description whatsoever which results from any of the following:

  • The fault of their person/s affected or any member/s of their party
  • The fault of a third party not connected with the provision of your stay which we could not have predicted or avoided
  • An event or circumstance which we or the supplier of the service(s) in question could not have predicted or avoided even after taking all reasonable care.

16. Use Of The Internet

Hotel Farinet will make all reasonable endeavours to make Wi-Fi, internet, telephone and other technology services available 24 hours a day. However, hotel is subject to the services and network of third party providers and cannot be held responsible for loss of service or poor service. Hotel Farinet is not responsible for security, integrity, accuracy or completeness of any information that the Client transmit or receive while using the Wi-Fi or internet services on site.

Wi-Fi and internet access in Hotel Farinet is provided on the basis that Clients use is lawful and honest. Hotel Farinet reserves the right to terminate a Clients use of the service at any time without notice if it becomes aware of any behaviour that has a negative impact on its equipment or network or the use by other Clients of the equipment or network or the internet in general, or which damages, or has the potential to damage, the hotel reputation or standing.

17. Withdrawal Of Hotel Farinet From The Agreement / Force Majeure

Hotel Farinet may withdraw from the contract for an extraordinary cause, i.e. if the performance of the contract is rendered impossible by force majeure or other circumstances for which Hotel Farinet is not answerable. Should it be made impossible for Hotel Farinet to provide all or part of the services which it is contractually obliged to provide, as a consequence of an event of force majeure (according to the Swiss understanding particularly natural disaster such as heavy gale, floodings or earthquakes, as well as taking of hostages, war, riots and nuclear incidents, strikes, unforeseen regulatory restrictions, etc.) or other circumstances for which Hotel Farinet cannot be held responsible, Hotel Farinet may withdraw entirely or partially from the agreement in respect of that part of the agreement which remains to be performed, without being under an obligation to pay any compensation.

If Hotel Farinet is booked on the basis of misleading or false presentation of material facts or if Hotel Farinet has reason to believe that the Client might use Hotel Farinet for a purpose that could affect its business operations, security or public image.

18. Intellectual Property Rights

Client acknowledges and agrees that all intellectual propriety rights, including, but not limited to copyrights, trademarks, database rights, patents and inventions, in relating to the services are owned by Le Farinet SA.

19. Final Clauses

The hotel reserves the right to assign or sub- contract any of its rights and obligations under this agreement without notice to the Client.

If any provision of this agreement is found to be unenforceable by a court of competent jurisdiction, the other provisions will nevertheless remain in full force and effect.

Although every effort has been made to ensure the accuracy of the information contained online, Hotel Farinet cannot accept responsibility for any errors or omissions, and reserve the right to vary, amend, supplement or cancel any of the information or offers featured online at any time.

20. Acknowledgments

By confirming and guaranteeing the reservation, the Client indicates that he has read, approved and agrees to abide by these General Terms and Conditions.

21. Governing Law And Dispute Resolution

The laws of Switzerland shall govern these present General Terms and Conditions as well as all the agreements regarding the stay at Hotel Farinet.

Any dispute arising out of, or in connection with, these General Terms and Conditions as well as all the agreements regarding the stay at Hotel Farinet shall be submitted to the exclusive jurisdiction of the Courts of the Canton of Vaud at the registered office of Hotel Farinet, Switzerland, subject to any appeal before the Swiss Federal Supreme Court.
